We note that a communication is currently being circulated within the market concerning alleged non-payment of inspection dues in relation to MV Chandrakant, in which our company has been referenced by China Marine Surveyors.
We hereby formally and unequivocally reject and refute any and all allegations made by China Marine Surveyors against our company. The statements contained in the circulated communication are inaccurate, unsubstantiated, and misleading, and have resulted in
unwarranted reputational prejudice.
For the avoidance of doubt, our involvement in the referenced matter was strictly limited to that of a shipbroker acting in an intermediary capacity. Our role was confined to introducing the vessel operator to the inspection service provider for the purposes
of their potential engagement as supercargo/inspection service provider. At no time did we enter into any contractual arrangement with the service provider, nor did we undertake, expressly or impliedly, any obligation in respect of payment for the services
rendered.
Furthermore, no invoice has been issued in our company’s name, and we have neither acknowledged, accepted, nor assumed any liability in connection with the subject claim. Any assertion to the contrary is without a legal or factual basis and is inconsistent
with established principles governing maritime commercial transactions and agency relationships.
We are further given to understand that the underlying cargo operations resulted in material damage and financial loss to the vessel operator, who has accordingly disputed and declined the claim in question. This dispute remains strictly between the contracting
parties. While we have, without prejudice, made reasonable efforts to facilitate communication between the parties, we are neither privy to the substantive dispute nor liable for its outcome.
The dissemination of allegations implicating our company, absent from any contractual nexus or legal foundation, is a matter of serious concern and may constitute defamation and/or injurious falsehood under applicable law. We expressly reserve all rights and
remedies available to us, including the right to pursue legal proceedings for any damage sustained as a result of such conduct.
All recipients of the circulated communication are requested to take due note of the above clarification and to disregard any statements that incorrectly associate with our company with the alleged claim or liability.
